Terms and Conditions of Sorted Eat Scheme

The Sorted Eat scheme

The Sorted Eat scheme is run by Sorted Ventures Ltd (“Sorted”) for its Sorted Club Members (“Members”). Sorted Eat provides its Members with recommended independent restaurants through the Sorted Eat App and the Sorted Website. Some of these restaurants also provide offers to Sorted Club Members.

 Access to the Sorted Eat scheme and access to any offers provided by restaurants to Sorted Club Members is available to current Members only.

1. Terms

This is the agreement between you and Sorted regarding your participation as a Member in the Sorted Eat scheme.

 These terms, together with the Membership Terms, set out the whole of the agreement between you and Sorted relating to your participation in the Sorted Eat scheme. Our general terms and conditions also apply to your use of the Sorted Website and App, and these can be found here.

 Please note that each restaurant featured on the Sorted Eat App and the Sorted Website has its own terms and conditions and that your Sorted Eat reservation and/or dining experience will be subject to the terms and conditions of the relevant participating restaurant which can be viewed on their website. You can access the website of all participating restaurants here.

 Please read these Terms carefully before you visit a participating restaurant.

 2. Reservations

 Note that we cannot guarantee the inclusion of any participating restaurant in the Sorted Eat scheme for the entire duration of your Membership period.

 Some of the restaurants featured on the Sorted Website and Sorted Eat App provide offers to Sorted Club Members, however occasionally this can change and Sorted will have no liability for any changes in the terms and conditions or availability of participating restaurants.

 Reservations may be made direct with the restaurant, or where a restaurant supports the Sorted Bookings System you can book your table via the Sorted Eat App or the Sorted Website.  If you have any difficulties making your reservation, please email club@sortedfood.com where a member of the team will respond to you within 1 working day (Monday to Friday). For any immediate bookings, it is advised you contact the restaurant directly.

 Not all our participating restaurants take advance bookings.

 If you visit any of our participating restaurants without a booking and wish to take advantage of any Sorted Club offers, you will need to provide proof of your current Sorted Club Membership upon arrival. The restaurant will use reasonable endeavours to accommodate you unless it is not open or does not have the available space at the time of your visit.

 3. Offers

As part of the Sorted Eat scheme, some participating restaurants offer a ‘Sorted Experience’. Under the Sorted Experience offer the restaurant will supply one of the following items to each of the diners at your table in connection with the reservation made: a complimentary drink, or nibbles, starter, dessert, off-menu item, tasting platter or plate, kitchen access, or an equivalent item.

The nature of the complimentary item is entirely at the participating restaurant’s discretion.

The Sorted Eat App or Sorted Website will indicate where a restaurant provides a Sorted Experience.

 Unless otherwise stated in the terms and conditions of the participating restaurant, the Sorted Experience is not available in conjunction with any other special offers or discounts.

 4. Food intolerances and allergies

 It is the Member’s responsibility to check that the participating restaurant is aware of any food intolerances, allergies or other special food requirements that you or any member of your party may have and the participating restaurant will accommodate these requirements in accordance with its standard procedures, as set out in its terms and conditions.

 In the absence of negligence, neither Sorted nor its employees, agents or subcontractors can be responsible for, and all liability is excluded for, any allergies or intolerances to food or drink suffered by you or your dining party or any related personal injury, illness or death.

 5. Liability

 Sorted is not responsible for the failure of any participating restaurant to provide a dining experience consistent with a Member’s expectations. In the unlikely event that you are not entirely satisfied we ask that you raise this directly with the participating restaurant.

 All reservations are between you as Member and the participating restaurant, not with Sorted. We do not give any warranty for the quality of meals, goods or services accessed through the Sorted Eat scheme and our liability to you will be limited to the Membership fee. To the maximum extent permitted by law, Sorted shall not be liable for any indirect or consequential losses arising from your participation in the Sorted Eat scheme.

 Nothing in these Terms excludes or limits Sorted’s liability for death or personal injury arising from our negligence, fraud or fraudulent misrepresentation or any other liability that cannot be excluded or limited by English law.

6. Writing reviews

Members are encouraged to write restaurant reviews using the feedback forms available to Sorted Club Members.

7. Data

We take the integrity of your personal information seriously. Please see the Sorted privacy policy on our Website.

8. Queries

If Sorted needs to contact you, we will use your contact details provided in connection with your Membership. It is your responsibility to inform us of any changes to your contact details.

9. Other important terms

We reserve the right to change these terms and conditions by notice in writing at any time.

 All intellectual property rights in connection with the Sorted Eat App and scheme, the Sorted Website and its know how and other content is and remain the property of Sorted.

 All disputes arising out of the Sorted Eat scheme and/or these Terms shall be governed by English law and subject to the exclusive jurisdiction of the English courts.
